I used to work for my previous company in USA on H1B. The approval notice said that my H1B was valid from 22 March 2002 to 1 March 2004. At that time, i was still in USA and then changed status from F1 to H1B.. Then I visited my home country for holidays in Dec 2002 where i had to issue H1B visa on my passport so that i could re-enter USA.. On my passport, H1B visa was issued on 2 Jan 2003 and would be expired on 01 March 2004.
Later, i resigned in August 2003 and returned back to my home country at the end of August 2003.
As you know, my H1B visa has already expired on 1 March 2004.. I have physically remained outside USA for more than 1 year.
Now my former company would like to rehire me..
Here i would like to ask some questions as follows:-
1) Is my six-year limit resetted? If not, what is my total years of being on H1B status?
2) When filing petition, which classification should my employer choose?
A) New Employment
B) Continuation of previously approved employment without change
C) New concurrent employment
