H1B, MBA confusion...

i am currently on H1B, but i have the option of a full-time 2 year MBA program starting this fall 08.

I understand that i will have to change my visa from H1 to F1 again, but my question is when I graduate, will I need to get a NEW H1, or can I just 're-activate my current H1" since I have only used 2 yrs so far.

However, I have already done a MS degree, and hence, I won't be eligible for OPT after my MBA (at least this is what many people have told me)...

how long can I remain in the US after my mBA, in case I haven't found a job by then?

For studying H-1B is not a feasible option as you need to maintain employment with the sponsoring company. You can change to F-1 and on completing the course you become eligible for OPT. Since you didn't used up all the years of H-1B, you can revert to H-1B status (for the remaining period) and this is not quota subjected.

Thanks for the input. I will surely convert my H1 back to F1, when i do my full-time MBA.

My main concern is the fact that I won't be eligible for OPT after graduation, since I already have a MS degree in the US, for which I used OPT (and according to my understanding of the USCIS website MS=MBA).

Hence, when I graduate, and if i am not eligible for OPT, I know that i have about 60 days to remain in the US. But how long does it to take to 're-activate' my H1B? Does the start date of the H1 has again to be October 1st, even if i am not counted against the qouta, or when the H1B is re-activated, can it be from June 1st?

You would not be subject to the quota, so you can restart your H-1B status at any point in the year without worrying about October 1.

But I hope you will be going to a top 15 business school. Because for the rest of them, you're probably not going to get any additional benefit professionally than what your existing Masters gave you. You'd probably be better off using the time to get two more years of work experience.

Yes, I have an offer from a top-15 MBA school. So, I am sure it will help in my career, as long as I over come the H1-B situation.

It is good to know that I won't be counted against the H1B quota. However, I am still looking for some clarification regarding the fact that I won't have any OPT after graduation. Does this mean, I will have ONLY 60 days after graduation to find a job???

In case, I am unable to find a job within 60 days, can I enroll in a community college and keep my student status, until i find a full-time job?

If you're going to a top MBA school, I would hope you'll have a job months before you graduate so this whole 60 days thing wouldn't be a problem. I do know it's possible not to have a job by graduation, but really think you should be able to have a job by then if you're indeed going to a top MBA program.

Same issue: I am also planning for MBA in next 2 years.
Can someone explain that H1B can be transferred even if my current Job is related to Technology and after MBA I might be working in something entirely different.
What happens to LCA etc..

Thanks

I know someone who worked with H1 in technology before MBA and now working in consulting post MBA. There was no need to file a new H1 on her behalf. The old H1 was reactivated.
