H1b Lay off Married to US Citizen

Hi there,

I might be getting laid off my company and I am on a H1b. I got married this Feb to a US citizen but my job safety made me delay filing my green card through my wife. So, if I get laid off tomorrow (friday) through my H1b and I file I-130 on Monday, can I stay legally in the US (Lets say I get 3 months of severance/pay stubs, should I be ok)? I will also file rest of the green card documents next week. What are my options?

File for green card ASAP. You will not be able to work until receive authorization if you lose your H1B job, but that is a minor problem.

You can mail USPS priority mail on the weekend. Your receipt will be time stamped. Save it.
