Hi,

I was in the US on H1B b/n 2000 and 2001 for about 11 months and came back to India.

I was in the US on L1B b/n 2003 and 2004 for about 11 months. When I got my L1B, I got it for 6 months ie, it was valid upto Jan-5-2004. So, our company applied for extension on 10-Oct-2003. My Visa and I94 became Invalid on Jan-5-2004. Since we had a reference number (applied for extension) our company lawyer said it is OK to stay in the US. On 2-Apr-2004, we got "Request For Evidence" from CIS. We prepared the documents towards it and we applied for it. In the mean time, our lawyer said, most of the visas that come for RFE will get rejected and if my Visa gets rejected, since my VISA and I94 are invalid, it is not good to stay in the US. It will become invalid stay in the US. Though, 180 days permission is there to be in that status, they (Lawyers) felt, it is better to go back to India. Our company also did not want to take risk and hence I came back to India on 9-Apr-2004. Once I came back to India, our company applied for Visa cancellation and Visa got cancelled.

Now, I left that company and joined a new company.

Case 1.
My new company wants to process my H1B. - Company A

Case 2.
The same consulting company through which I came to the US in 2000 also wants to process my H1B. - Company B

Is there any chances of my petition getting rejected because, my L1 extension got RFE and then it got cancelled?

What measures do I (our company) have to take during H1B petition so that we should not got into any troubles (RFE) this time?

Is premium H1B favours me?

Can both the companies start processing my H1B?

Processing through Company B, has got any favour towards me as I already had one Visa with the same company?

Please let me know.
