H1B Job Agreement, Advice needed

I really need your advice.
I am planning to resign from my consulting firm, I need ur inputs.

I am working as a contractor for company A and my project end date is in
september, A extendes the project end date, only when the last date arrives.

My contractor has a agreement with me" Which states that i am at will
employee and i can resign any time with or without reason by giving 2
week notice"This guy doesnt pay on bench and did not pay me when i
came to USA(He showed me as an employee after 1 month, when i got an
project). I cant wait to resign, after i am out of A.
My Agreement also says that i have to pay him the relocation expenses
he has spend on me if i resign within a year.
I signed the agreement in India, and the consulatant signed it in California.
Please advice.
Can he force me to work,Can i ask for the slips of the relocation expenses.

No employer can force you to work, but they can ask you to refund the relocation expenses. Usually most companies ask for prorated amount, but consulting houses are not "most companies".. so I wouldn't be surprised if your agreement calls for a full refund.

If you joined work and the employer did not pay you, you can complain about your employer to USCIS/DOL, with their renewed focus on weeding out shady employers, USCIS/DOL will hopefully force the company to pay you for the month on the bench.
 
Dear SC3,

He didnt take me on the payroll, till i got the project,
He paid for my Motel for 1 Month 10 days, I was goining to office daily.
I was giving client interviews, not being on the payroll.

Someone told me , if i signed the agreement in india, it would not be law enforcable in usa.

Please suggest,
