Can my employer file my H1 but not pay my wages as per the H1 agreement
Hi All,
I have a problem. I worked in a company in the bay area for 1.5 years. Last August, the company offered me full time employment and processed my H1 papers as per california laws and labor standards. However, immediately after that, I was advised to go to India for business. However, I resigned from the company in January 2005. The company has not paid me my salaries as per the employment letter and H1 agreement. I would like to know, what references I can use to further validate my claim with the department of labor. Chronology of events are as follows:
August 24th: Offered Full Time
August 26th: FIled H1
September 8th: Received APproval of H1
September 8th: obtained my I-94
September 16th: Went for business trip to India.
January 7th: resigned from company
Company now claims that I was working for the Indian company and thus my claims are invalid.
PLEASE HELP!!! URGENTLY!!! WOULD LIKE TO KNOW IF THEIR IS A RESOURCE THAT I COULD AVAIL OR LOOK AT TO STATE EXACT LAWS UNDER WHICH I AM COVERED.
