Dear friends,

I am seeking help from all you veteran leaders in immigration and h1b ...

I am on H1 and do not have paystubs from the company for 5 mths since I was not placed on client site. Now I have got a good Perm job in a company after so many months. I dont want to miss this opportunity since its very good. Can you please guide me as to how I can go about the H! transfer without pay stub. Can I say something like medical leave or unpaid vacation or something like that?...There must be someone who is in the same boat as me....Besides complaining abt no pay, is there a way to work this out?......Pls help me guys....

From whatever knowledge I have and from my personal experiences with H1B transfer I can tell you that it does require last couple of paystubs to transfer your visa to another employer.
However I also know someone who got his visa transferred once without paystub, but that could just be pure luck. In most cases the answer is Yes, you do need latest paystubs to prove that you were not out of status.

I have no idea about medical leave or unpaid vacation, not sure how that will work. Maybe you can consult an attorney regarding this.
 
Do we need to give the paystubs at the time of submitting the paper work to the attorney ?...when does the paystub come in...do we need to send copies of the paystubs along with the H1b application ?...Or does the paystub thing arise if there is an RFE etc?....
 
I do not know answer to that question. I have transferred my visas couple of times and all the time I give my latest pay stub to attorney with initial application. Maybe this is not true for all service centers they might have different rules you need to check with attorney.
 
My h-1B was transfered to new company without paystubs. Not that I don't have them but lawyer told me they weren't necessary to send. As GC_lover says, it could be luck mine was approved without these documents. Transfer was approved last month.

Pay stubs are required.
