H1B --> I-539 to F1 denied

Hi everyone,

Last year my H1B visa was expiring and I filed I-539 to change to F1 as advised by my attorney. Recently I received a notice from USCICS that it was denied.

My attorney said I should prepare to leave the country ASAP, but could not give me how much time I have. He said two things: 1) 10 days from the date of receipt of the notice, 2) Maximum stay of 120 days without penalty. I was advised not to go to local INS office for inquiry and "reasonable" amount of overstay should not cause problem.

I've been reading posts about overstay. In my case exactly which date the overstay begin - from the date of H1B expiration, or I-539 denial? And how long am I allowed to stay here in the States?
