H1B holder got selected in DV Lottery

Just now I got the first letter from Kentucky Consular Center that is mentioning that I am selected in the lottery for 2011. Right now I am staying in USA with H1B visa. They have given me a case number starting with '2011'. I went to their site tried to understand what should I do now. May be I am wrong, but what I understood is I can Adjust Status only if I am eligible for that but I didn't find any clear-cut criteria to confirm if I am eligible. Can you please tell me how can I verify if I am eligible to Adjust Status?

If I am eligible to Adjust Status then what should be my next step? It would be really helpful if you could help me in this regard.

you should be eligible to aos on a h1b. but the question is when does the h1b expire and what is your cn#. it will be helpful for the more experienced posters here to help you if you can edit your signature with your location and cn#.
your next step is to send in your forms/pics/dos fee according to the instructions on your first nl.

first of all congratulations!

A lot will depend on your case number (CN). You can put it in your signature and blank out the last 3 digits, as it will help other people giving you better advice.
If it is low enough adjustment of status (AOS) could be a viable option, otherwise you can opt for consular processing (CP).
I used to have an H1B, but have a green card now and I might be able to answer any questions you might have. Feel free to PM me or post them up here.

- H1B will be expired sometime in 2013
- My case number: 2011AS0001XXXX
- In the mail that I got there is no form and it was mentioning to visit dvselectee.state.gov for next instructions

What I understood from that site and visiting other sites are below and correct me if I am wrong:

- I don't need to fill up and submit DSP 122 and DS 230 (Part I and II)
- I will have to submit i-485 and Supporting Evidence for Form I-485

I have downloaded i-485 and not sure which option I will have to select (a to j) for Part 2 (I am applying for an adjustment to permanent resident status because .... ), can you please tell me which option I should select?

Where should I submit/deposite i-485, supporting evidence for form i-485 and fees?

I'm also a winner for 2011. I receive a letter asking me to visit vselectee.state.gov for next steps. My case number is also in the region of: 2011AS0001XXXX. I'm bit confused by instructions on dvselectee.state.gov and would appreciate any advise you can provide for to move on the next steps. Do I need to fill out and send DSP 122 and DS 230 (Part I and II)? or Can I just apply for AOS?

Hello zahidal,

H1B visa holders are eligible to apply for AOS. For this fiscal year, your case number became current in February so you should be fine for AOS.

You DO NEED to mail the form DSP-122 with the photographs back to the KCC. You will also need to send the DV fee to the KCC. Some people don't send the DS-230 when applying for AOS but I did it anyway to be on the safe side (I applied for AOS under the DV 2010).

The form I-485 is for the AOS application. You should submit it when your case number becomes current or when you see your case number becoming current in the section "advance notification of the diversity visa section" of the visa bulletin. The visa bulletin is issued every month, you can check it here http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html

I strongly suggest that you read the forums DV 2010 AOS Only and DV 2009 AOS Only. You will find valuable information and you'll understand how the process works.

Hello Sand2010,

You need to mail the DSP-122 and photographs back to KCC. That's the way that you inform KCC that you decided to go for AOS.

When you apply for AOS, the USCIS will request your file from KCC. The KCC will mail it to the USCIS only if you paid the DV fee and if you submitted the DSP-122.

Some people submit the form DS-230 even though applying for AOS (me included).

Am I right? Do you know how much I will have to pay at the time when I will be applying for i-485?

He is saying that this year, that case number became current in February, so, it should be approximately the same thing, next year, for you.Your number should be current around February 2011.

Sorry I was not clear. If you compare your case number with previous Fiscal Years, you'll see that you should become current by February 2011 (if the trend of cut off numbers continues). Remember, the key is that you have to get your Green Card before the end of the Fiscal Year (in your case 09/30/2011).

Yes, you need to pay the DV fee to the Department of State (the KCC is the DOS' center that administers the DV program).

This is how it works if you apply for AOS:
1) Send the forms to KCC asap.
2) Send the DV fee ($375 for each applicant) to the Department of State
3) When you case becomes current, then send the I-485 along with supporting documentation, medical, photos, filing fee of $1,010, etc to the USCIS.

Right now, they're still processing 2010 winners. The fiscal year for 2011 Winners start in October 2010. i2009 just gave you an estimate on when your number will be current based on the this year and past years Bulletins. I am bit confused one more time. What does 'send the $375 Visa fee to DOS not KCC' mean? There are two things:

first: in the check I need to write down the receiver of the check. who is the receiver 'U.S. Department of State' or 'Department of State' or any other?

second: to which address should i send this $375 check along with the 'Adjustment Of Status Fee Payment' form?

I have some questions about this

1) In the check to DOS ($375), who should we write as the receiver of the check? Department of State?
2) Also, since I am the principal applicant - and we are worried that there is no place in the DSP 122 where we have to enter my wife's name?
