H1B/H4 processed at the same time?

Hi

my employer is applying for an academic H1B for me and an H4 for my wife. My wife's company will file an H1B for her with premium processing, but they haven't started yet. The H4 is only our safety net, but we are worried that it gets approved before her H1B, so we are considering to file it later.
My question: Does VSC adjudicate/approve H1B and H4 (sent together) usually at the same date? The processing times look much shorter for H4's than for H1B's right now...
Can anybody please help? What are your experiences?

Which visa do you want your wife to be on: H1 or H4??

It depends on this question because the "Last Action Stands" rule.

I am planning to apply for an H4 for my wife together with my H1B (in case she is too late for her own H1B for this year because of the cap or something else goes wrong). In parallel she tries to get her own H1B with premium processing via her employer. She is currently working on a J2 permit and she wants to keep working.

Do you mean that if she receives her H4 approval AFTER the H1B approval (that's the situation we would have if everything goes "right") the H1B is invalid?

This would be a very important info. Because then we would wait if she gets her H1B and would only apply for an H4 if the H1B goes wrong.

sorry if I was not precise enough in my previous email. Of course we would prefer an H1B for her. The H4 is just to keep her in status in case her H1B goes wrong.
 
In my personal opinion, you should first get her H4 approved.

Thereafter, apply for her H1B. This raises 2 situations:

1. Her H1 B is approved.In this case, she can start working for the employer by getting on the payroll and it would be deemed that she is on H1B. If she does not get onto the payroll even after 60 days(I think) from the start date on her H1B, then she will be considered to be on H4.

2. Her H1B is denied.No worries because she already has her H4 approved.She can continue to legally stay.However, she cannot work.

By the way when does your J1/J2 and your I-94's expire? Give the exact dates for each.
 
H1B Start Date ?

Is there a limit on the start date from the time of H1b Start Date ? What is this 60 days limit and where can I find more info on it ?

My Personl suggestion will be, be a male and try to keep your family with yor earnings, stoooopppp... forcing a female to work.. let her to be a good house wife....

Why you want your wife to work
- are you handicapped- unable to feed your family.. :mad: ?
- are you a lion( will relax and sleep while lioness hunt for food in all ways :p )?
- want to have more money by forcing a female to work?
- Unable to control your wife( she want to stay away from family)?
- don't have kids so she's bored at home? :confused:
