I am on F1-OPT, and while pursuing my degree, I got job offers from two different companies (A and B).
Both companies filed for H1B, and the lotteries were not picked in the first attempt, so I picked a company and started working.
Company A: I started working in March 2023.
Company B: The joining date is November 2023.
In the second lottery, my H1B was selected from Company B (job offer starts in November 2023).
So,
1. Can I ask Company B to file my H1B petition?
2. Since the offer date with Company B is after October 1st (i.e., November 23), will the USCIS approve the H1B?
3. Will there be a counselor's processing (as job start date is after October 1st) for a change of status from F1 to H1B?
4. Should I join Company B for H1B to become active?
5. How can I transfer the H1B (if approved) to Company A without joining Company B?
