My H1b visa will be expire by the end of this September.... i confirm that my employer will not extend another H1b visa for me because of economy condition.... my options are getting my jobs or go back to study ...

i wonder if there is any grace period once my H1b visa for change of status or is gonna be same as laid off situation, expire right after the last day of my visa... i ask this because i might not have enough time to get admission to school .

There is no grace period. Overstaying the I-94 date has serious consequences. If you have not been admitted to school, you should leave to avoid illegal presence and return only after having gained admission. You could also request COS to B-2. Remember that many programs permit entry only in the fall semester; a B-2 will not give you enough time to remain until Aug 2011.

A student visa is for studying; it is not for simply remaining in the US. You will be reported to ICE/DHS for deportation if you do not attend classes so please consider carefully your reasons for applying for admission. You may be better served by returning to your home country to work and reapply for H1B once the economy improves.

Is it not an option to find work with another employer? Also, enrolling in school is definitely a legitimate option for you. It depends on whether you can find work or have the means to enroll in school. I would think enrolling in school would be the easier choice, but it depends on your situation. Please let us know how this works out for you!
