My Perm was filed March 26th 2009, and 6 year H1b is due to expire on June 25 2009.
Perm is still pending so I am looking at going on F1 in end of June. The question is when can i change my status back to H1B?
1. If say the perm application is approved sometime in september and I file for Premium 140 and get that approved by October, can I change my status back to H1b based on that approved 140?
2. If 1 cannot be done, can I wait till the perm application takes its time and take my time to file 140 so that it is still pending by March 26 2010, can i then request to change over to the 1 yr H1b visa based on the pending green card application for 1 year?
Looking for some guidance on the options - I am not sure that based on the approved / pending 140 - can i switch back to H1b from a F visa?
