My H1B is expiring in May'06. Labor is filed in October'05. Now if my LC and I140 both are approved before current H1 expiry, can I get H1B extension for 3 years under AC21 clause.
Point to be noted here is that 365 days since Labor filing will not be over when my current H1 expires.
Can I still qualify for AC21 if I have approved LC and I140, even if LC application was not filed 365 days prior to H1 expiry??
