H1B Extension ?

Hello,

My I485 was filed on Aug 9th 2002
My EAD expires in Oct 2003
My H1B expires in Jun 2003
I will complete 6 years on H1B in Nov 2003.

I had the following questions:

(1) Do I need to extend my H1B? (Pros/Cons)

(2) If I do extend my H1B, what will be the end date for the new H1B? Will it be Jun 2004 or Nov 2004?

Hi,

It all depends on you perticular situation. If you need to get married and bring your spouse on H4, you need to extend your H1. If you decide to extend your H1 it will be valid till Oct 2003 as you are going to complete 6 year term by that month. If you want to extend it beyond that time provided your 485 is not approved by that time, you need to extend it for the seventh year which requires some conditions to be fulfilled which I am sure you are aware of.

If you don't have to bring in your spouse on H4, then I feel extention of EAD will do. Going by current processing times, your 485 should come through around Oct/Nov 2003.
