H1B extension

Hi everyone,

I’ve been through the weirdest H1B situations that I know.

Story is pretty long, so I’ll try to cut it and go straight to the point:

• Employer filed H1B on September 2002, for period September 2002 – August 2005.
• After two - three denials and appeals, INS asked for new LCA, because previous expired.
• My employer sent new LCA with new dates 06/30/2005 – 08/12/2008.
• Finally I got approved on April 2005, valid dates from 06/30/2005 – 08/12/2005.

As you see, I got approved to work month and twelve days.

The questions are:

• Can I start to work now, cause I’m in the USA already or I should wait for valid dates and start to work on 6/30/05?
• My company is willing to extend my H1B, so when they should do it? Employer says that I should wait for valid dates and then to start to work. Then to wait for my first two payroll checks and we can file premium processing for H1B extension in the mid of the July.

So, what do you think, is it correct what my employer proposes? I’m afraid no to be late and get denied for extension.

Any comment is more than welcome?
