H1B Extension - Waiting From March 02 - Gurus please help

Hello all,

I applied for H1B on March 25th 2002. Got a query in September 2002. The query was to make sure if I am going to work for all hospitals(working as Dr.) or one specific hospital.

Our hopsital responded by informing them that I will be working only for their hospital. Query was responded on 22nd Sep. I still did not hear from them.

I am stuck with this processing Since March 2002. Can any body please guid me what is the best way to resolve this issue. Also coculd you please let me know what would be the procedure if I have to make this process premium processing.

Lastly could any body provide fax number for VSC so that I can requrest hospital to send a note asking the status.

First thing that needs to be done is to call INS, speak to an IIO and find out what is going on. The longest procesing time that I have ever seen for an H-1 is 11 months (although I have heard of longer) so this is very unusual) so it is extremely unusual for an H-1 extension to take this long. To convert to PP you need to file form I-907 and pay an additional $1000 fee. The problem you have now is that filing an extension only authorizes you to work for an additional 240 days post I-94 expiration. If this period has expired and you are still working you are working illegally and this will cause very serious problems for you.

You need to speak to your attorney regarding these issues immediately. This situation should have been addressed long ago. If your attorney is an AILA member, there is an escalation procedure available and it is possible to seek the intervention of the AILA liason for the appropriate service center.
