Here is my situation. My Visa / I-797 was valid until Mar-10-2011. Filed for an extension in Feb 2011. Got an RFE and later a denial on Apr 8 - 2011. Officially notified on Apr -11 -2011. My employer again filed another lca on Apr 13-2011. Left the country on Apr 23-2011. Filed my I-129 on May 3-2011. Now I have another RFE.
Maintenance of Status -
"You stated on the petition that the non-immigrant's status expired on mar-10-2011. This petition was filed on May-3-2011. Please submit evidence that the beneficiary is continuing to maintain a valid non- immigrant status".
"You have stated that the beneficiary will apply for his visa at the chennai consulate in the event USCIS is unable to grant the beneficiary an extension of stay".
Please let me know how and what evidence do I have to provide the USCIS.
