I currently work for Company A and Company B has filed labor for me on the basis of future employement. I am nearing my 6 yrs of H1B with Company A.

Can Company B now file a 7th year extension and I can start working with Company B once I receive the reciept number?

OR

Should Company B first file a H1 transfer and once it receives it, then file a 7th year H1 Extension?

Any Help greatly appreciated.

Thanks!!!

H1-b

First file the transfer. When that's approved and you have received it, file the extension.

If the LC is already pending for over 365 days,

and you H-1B is expairing within 6 months, then you can file transfer and extension together.

Company A filed my Labor on Nov 7th 2004. and the H1 is expiring on
Dec 29th 2005.

So as I understand I need to file transfer and extension together after
Nov 7th 2005?

From the finance perspective of the fees with INS -
Will it be considered as single filing with INS or two different filings?

Appreciate your Help.

You should file transfer/extension on Nov. 7.

It should be considered as one filing. At least that was what my attorney told me when they attempted to do the same for me. Unfortunately, my dates of transfer and 6-month-prior-to-expiration were 1 month apart. So USCIS only approved the transfer at that filing.

This is based on my attorney's opinion and practice.
