H1B Extension -Labor case missing in DOL

Is there anyone with this scenario ?

H1B extension for my 9th year is due in March. Did not receive a 45 day letter. My attorney contacted DOL and trying to rebuild the case. DOL has given a temporary number.

Can we apply extension with the temporary number ?

How did you get the 7th & 8th yr extn's. Did you use the receipt issued by DOL prior to your case being shipped off to BEC's? Did you ever get a screen shot from BEC confirming your case is pending with them?

In any case if the pertinent BEC or DOL has issued you with a temporary case number then they are in effect confirming the filing/pending status of your labor petition. For the purposes of H1 extn this should suffice...

We had the ETA Case number from DOL which was used for earlier extension.

yes for my previous extensions they used my ETA case number.My attorney is saying the that ETA number is useless in the wake of new rule (submit snapshot of BEC).

Did you ever get a screen shot from BEC confirming your case is pending with them?
No. We never got a 45 day letter.
