H1B extension and a new job

I have an approved labor and I-140 at my current company under EB-3. My H1B expires in April, 2007. I'am considering changing jobs and I was wondering if I can get an H1B extension later at a new job even though a new labor/I-140 is not approved at that job? Can I use my current I-140 approval to get my H1B extension at the new job?

Thanks Compiler. But I did not see if any of the portability discussions in the memo applied to my situation directly. Can you be more specific? Thank you for your help.

You can file the 7th year H-1B extension from a new company as long as you have an LC filed one year ago.

My LC was filed in October 2001. And I even have I-140 approved now. Will I get the 3year extension at my new job or just one? Thanks for your input.

Depending on whether you are subject to per country visa limit at the time of filing the 7th year H-1B extension and whether the Service Center allows you to invoke the AC21 104(c) by the different company’s approved I-140. But, you can try. You should, however, be granted one year extension at least.
