Can anybody tell me the exact rule to get an extension for H1B after 6 years? There are few scenarios as given below, I know first three of them, but waiting for answer of the last or fourth one from you.
1. I-140 is approved and can not file i-485, then eligible to get 3 years extension at a time.
2. Labor certification is filed and pending for more than 365 days, eligible to get 1 year extension at a time.
3. Emigrant petition(I-140) is filed and pending for more than 365 days, eligible to get 1 year extension at a time.
4. What about if labor is filed before 365 days of H1B expiry and it's approved and then I-140 is also filed and pending for less than 365 days of expiry? Shall anybody is eligible to get an extension in this scneario?
