H1B - Expiring - Vacation Recapture - AAO Recapture Ruling - Help

All:
I need a recapture of 23 days to file for H1B 7th years give there insight on how the ruling of AAO is going to affect USCIS to allow the recapture any number of days? What are the chances of getting to get the recapture ( along with extension) in lieu of this current AAO memo?. What are pros/cons ? My case in reapplied - as it has been denied right the moment the AAO ruling is passed. And my lawyer has re-appealed the case with new aao's recapture-ruling's.

Any insight ..suggestion highl appreciated..plz...
