H1B expiring next year

Hi,

My HIB is expiring Oct 1 2011.My company has decided to apply for my GC. Inorder to extend my H1B beyond Oct 1 2011 should my Labor be applied before Oct 1, 2010? I am from India.

Also I believe the ad has to be posted for a minimum of 30 days prior to applying for my Labor? Could that be confirmed as well? Am I very close to the deadline?

With just over a month, I doubt that there is enough time to get through the PERM process in the time you have before the beginning of your 6th year if your employer does not now have it well underway.

Besides just posting the ad, you employer must allow for interviewing qualified applicants; they cannot just dismiss everyone as unqualified.
