H1B exempt cap Inquiries please advise

Hi Guys,


I have two questions please:

1- If I got a job offer from a non profit organization or a research government organization ( I have a BA, still working on my master), will I be considered for the cap exempt H1-B visa?or do I have to have a Master in this case?



2- On the Website they say that FY 2005, 2006 cap-exempt H-1Bs are still available, how is that? can I apply now for the FY 2005 even the start date was October 2004? I am confused please advise.

cap exempt offer means exactly that cap-exempt. so if u get such an offer u will need masters only if job descrioption requires it.

Fy 2005 means that the year started in 1st Oct 2004 and ends 30 =Sep 2005, and an H1 with a start date between these dates belongs to this year and one after this date to next year. So if you apply for H1 now with a start date on or before 30 sep 2005 it will be FY 2005 while start date after will be Fy 2006. Now since there is still time left before 30 Sep 2005 there are cap exempt H1s available for FY2005.
