H1B/EAD status

Hello,
My H1B got expired on Sept 03. I have my EAD valid till JAN 2004. I applied for I485 in Oct 02. Do I have to renew my EAD for next year? Can someone explain which status is more benefictary?

My lawyer is suggesting me to maintain H1B and to renew EAD only when it is needed.

If u had applied for H1 BEFORE ur current H1 expires, it would be considered as an extension.
If u have not applied for H1 extension AFTER ur current H1 expired, then the H1 u apply for will be considered as a new H1.

U have to apply for EAD extension atleast 3 months before ur EAD expires - so that u can get iEAD even if ur EAD is not approved.

It is ur choice whether to extend H1 or work on EAD.
