hi

I am currently on H1 B with Employer A (expires 2004)
Going to use AC21 and EAD to join Employer B

If things go wrong with Employer B can I use the old H1 B with Employer A and come back...

Does any one have any idea...what is the best way to do this..?
Also is it mandatatory to Infor INS abt this..?

Thanks in advance and appretiate your responses.

It is not mandantory to inform INS about using AC21 and changing employers. Some laywers recommend to inform the INS others recommend the opposite. In case you didn't know, the INS has no form for AC21 so if you choose to inform the INS you would have to write some sort of letter outlining the new job description and pay. I think that if you use the search function you might find examples of this letter posted by some members on this board.

Regarding switching back to H1B, I believe it is not possible, but you could of course go back to Employer A and use your EAD card. So if your question is if you can rejoin Employer A then the answer is 'yes' (it doesn't really matter if the status is EAD or H1B).

Hope this helps...
