I came to this country with an H1 from Company A. Four Months back I got a job with Company B which I joined based on the Receipt for a new H1 petition from Company B. My H1 petition from Company B got denied. Can I go back to work for Company A where my H1 expires December 2003.
My Lawyer says that I can since I still have a valid H1 from Company A, but that I have to leave the country and re-enter to get a new I-94. Please advise if this is true. I don't trust my Lawyer a whole lot right now as he had promised that my new H1 would definitely get approved.
