H1B cap Industry to University to again idustry

I got H1B(from F1) through Private company (Subject to Cap) in april 2003.
Then i moved to University(Not subject to cap) in September 2003 on H1B.Again I want to move back to Industry on H1B.

The federal Register says people who subject to cap in last six years will not subjected to cap limitations. Am I interpreting wrongly? Do I subject to Cap if i want to move back to industry?

You are not subjected to CAP..

You were initially subjected to CAP and your visa is already counted once... and moving to University doesn't make difference ( for the same fact that your visa is already counted).


If somebody say.. changed from F1 to University H1 and then to Industry H1, he would be subjected to CAP
