I had a H1B visa from June 2002-2003 which was valid till June 2005. I changed over to a h4 visa in June 2003 in order to go to grad school. I now want to go back to a H1 B visa. The laws say that if you have had a H1B approval in the past six years and have not left th country for more than a year, then you do not fall under the cap. Since I fulfill both these criteria, will I be exempt from the quota? Will my change over to H4 effect my H1b cap exemption in any way?
