Im a new entrant to this forum.I have heard a lot about this portal and the valuable service it is providing.
With that hope Im giving my peculiar problem.
Please help me and suggest me what I should do.
The problem:
Im a software consultant from India with a very reputed firm.I was in USA on assignment and returned to India last year March 2004..My H1 visa was supposed to get expired in August.I was not getting a chance to go TO US from my employer then.I wanted to go to US again and tried for a job based on advertisement in a reputed newspaper.The company during my technical interview asked the photocopy of my existing H1.They said they want this so that the new H1 visa can be done quick.Incase H1 cannot be obtained they will try for L1 Visa.I trusted them.But they have cheated me and used my existing visa to send another person.
I came to know this and immediately reported to the consulate officials and police in India.I have taken appointment with Mumbai consulate and informed what all happened and given in writing nothing was wrong from my side.They have taken action against that company and the person was caught at Port of entry.But they have stamped as 'Cancelled without Prejudice' on my visa just on the day when my visa was expiring.
Now I gave another job offer from a US based comapany and they forwarded my H1 papers.I took appointment in April at Chennai consulate for stamping.
Please suggest me :
1)Will this create a problem to stamp my new visa or how can I convince the Consulate officials??
2)What documents should I take to convince the officials .
3)How should I convince that it is not my mistake (I doont want to hide anything from theofficials as they may suspect)
4)How serious is this issue
5)Will I get ever chance to go to USA
6)How should I proceed now like taking any letter of prrof from Mumbai consulate etc..
6) Anyone with same experience.
