I was previously on H4 when I came into the country after which I got a full time job with the same consulting company that filed my H1 from Oct 2007 onwards until September 2008.From Oct 2008 they stopped my payroll as they were cutting costs and asked me to work for them as a consulant instead.But because of the slump in the market they suggested I go to India for sometime.I left for India in Nov 2008 and returned end of january 2009 with the h1 stamping but my payroll has not run till date from Nov 2008
Is my status still in place?
What is LOA (leave of absence) or FMLA and can that be a valid reason for no paystubs and for how long?
For how long can one be in status without paystubs on H1?
Can I consider shifting to H4 and return to the current H1 when I can find a project?
If yes ,is the option to come back on H1 always open or only for a certain time period after which it will be inactive/cancelled?
Will there have to be a new H1 filed through the same lottery process?
Please help me with these questions.
