h1b approval notice / visa stamping

Hi,

I got 1st time H1B approval notice in 2004.
I went for Chennai consulate for visa stamping and got a 221g query on the company. Still waiting for the required documents from my employer.

If I apply for h1b with a new employer in 2005, will it be subjected to cap?
Any issues if I go for visa stamping again with this new h1b approval notice?
