H1b/ap

Hi,
If what I am asking is already covered in some other thread I would be grateful if you provide me the link to it.

I applied for 140/485 combined (ND 24rd Feb'02, 140 still pending) in EB3 category (substitute labor). I had my AP/EAD renewed once. Also I just got the Canadian green card and will be landing there coming weekend and returning after 2 weeks.

Please advise me on....
1) Should I come back on AP or H1B? The H1B visa stamp on my passport has expired and I will have to revalidate it in Canada.
2) What's the advantage/disadvantage of coming back on H1B/AP?
3) I heard that if 485 process can be sped up if we opt for consular processing in canada. Is this true?
4) Any other thing that I need to be aware of?

Thanks for the help.

I am not sure if the consulate in canada would validate your H1B. Check with the Canadian consulate.

None.

Again I am not sure if you can opt for Canadian CP.
4) Any other thing that I need to be aware of?
Changing to CP from AOS would require you to file I824. Check the processing dates of 824 in your service center. Many a times concurrent is faster or almost the same time as CP.

You can come back with H1B or AP what ever is valid that time. If H1B is expired you can come by AP. While coming from Canada what the embassy will see is you have valid papers or not. They don't put anykind of stamp on your passport. One advantage while going Canada is US immigration won't take your I-94 and they won't give you a new one while coming back to Us from Canada.

2) What's the advantage/disadvantage of coming back on H1B/AP?

There is no disadvantage. If your h1b expires come with your AP and you have to show EAD too

3) I heard that if 485 process can be sped up if we opt for consular processing in canada. Is this true?

No Idea about this

4) Any other thing that I need to be aware of?
