I am caught up in a strange tangle. I travelled to India with an AP backup and 485 pending. Went to get my H1B stamped, and the consulate held my passport for a background check. I thought it will be okayed soon, but it has been pending for a month. Meanwhile, the 485 is approved!! I am trying desperately to get my passport back and using my attorney's help to clarify to the consulate that I no longer require the H1. The consulate seems to be adamant on its stand to finish the clearance and therefore my passport is stuck.
Does any one have/had/know of a similar case? Any suggestions to handle this situation welcome.
