I am here on H1b

Around 1 year ago my grandmother's (us citizen) health deteriorated and I had to take LOA to take care of her as she has noone else in the USA

I asked for unpaid LOA from employer and he approved. He only asked that I come in about one week every month to do some work, which I did.

Now I have to extend H1b. I have pay stubs for every month but amount is very low because I only worked one week a month. Is that going to be an issue? how do you present this to uscis? I read its ok to take LOA for personal reasons as long as its employee initiated? will I have problems?

please help

thanks

Hi earthdefence,
As long as it works for your employer and you it shouldn't be a problem with USCIS. Using Form I-539 you can apply to extend the H1b visa and when asked explain truthfully your situation.Good luck!

you are allowed to take unpaid leave but be prepared to document the reasons for the leave and that you requested the leave and employer did not force you
