H1b Amend from Full Time to Part Time

Hello All!

I've came to USA this November on h1b visa. Initially it was stated that I will be paid full time at 78k annually. Now my employer pays me hourly and this is huge difference in amount from what was files initially.

First question - will I be in any status enough to file EB-2 with another company?

If no - I've heard it's possible to file amend to H1b to indicate switch to part time work and be still in legal status. How hard this? How much cost? Is it the same as getting new H1b in terms of costs, time, risks? Is it high risk to get denial on this amend?

You are not working according to the regulations and are worrying about filing a green card . You cannot file anything relating to an H1B petition. Get your priorities straight.

Of course, failing to maintain legal status is an issue in future immigration proceeding.

Either find a legitiamate employer and report this one to the DOL/USCIS for failing to meet his responsibilities or retrurn home where US law does not affect what you and your employer do.
