I am currently in my H4 visa in USA.I filed my H1B in June,2005 and I received the receipt from INS for the same.
My online Status in USCIS website tells that on August 2005 ,INS has sent a Query for Additional information to validate my current stay by providing information about my dependants H1B visa.I had sent the papers to my Employer and till date it is not filed to INS.When I called and asked him about the same ,he tells that the papers has been sent to Attorney and they will file it to INS only after a month.(ie in the end of Septemeber).The reason they tell for this is,its always better to reply to a query after a month ,so that INS doesnot come up with another Query.
Now please tell me if this procedure is right.If I can reply to a query from INS after a month.What is the time period within which a Query must be replied??
