H1B about to expire. Delay in getting the LCA!

This is my situation: My I-140 is approved and the I-485 is pending. I have maintained my H1B status, which about to expire on January 7th. My employer wants to renew the H1B; but they apply for the LCA last week and was denied because of the EIN was not found on record. They have already submitted the paperwork required to verify the validity of the EIN; but the have not received response that the information was corroborated. A second LCA application was denied. I am worry because if we don’t get the LCA we are not going to be able to apply for the renewal before the deadline.
My question is: Can we apply for the H1B renewal even after the January 7th? Any other recommendations or suggestion will be highly appreciated.

You cannot do anything. Your employer and his attorney are working on the problem. I doubt that any forum member would have any options that are not already known to the attorney. No reasonable attorney would follow a suggestion submitted to him by his client's employee's forum.

If your employer is trying to handle this without the assistance of an attorney, the best advice is for the employer to engage one immediately.
