Dear friends,
I have received 8th year extension from my Current Employer based on a pending labor petition from Previous employer.
Previous employer is not responding to the 45 days letter from BEC for the pended petition. I have applied a labor from third company which has been pending for more than 365 days but after 6 years expired. Can I use this petition to maintain legal status?
In other words,
1) First Labor pending more than 365 days prior to H1B 6 Yr limit.
2) Granted 7th & 8th Yr H1B in New Comapny based on pending labor.
3) Applied Labor from new company after 6 Yr H1B limit expired.
4) New labor has been pending for more than 365 days at this point.
5) Original labor is closed due to no response to 45 days letter from BEC.
6) Can I still maintain H1B legal status and get continued extensions based on the new petition that has been pending for more than 365 days but after 6 Yr H1B limt expired...
