H1B 7yr using previous employer's LC? Gurus help!

Gurus,

I will file PERM LC with my current employer soon. Unfortunately, I only have 10 months left for my H-1B. So I would not have a chance to file H-1B 7yr extention. But I have an RIR LC under my previous employer and pending in BEC.

I heard from a lawyer saying that I can file H-1B 7yr by somehow reseting PD to the date of my previous employer's LC under my name.

Is it true??? I am so confused! Please help! :confused:

Never heard of resetting the PD!

As long as your previous employer is willing to continuously support that LC ( responded to 45 days letter etc) and you have a copy of that LC Receipt with the Priority Date, you can get your H1B 7th year extension and work for any other employer. That is exactly what I have done and I am on 9th year extension.

Just in case you don't have that LC Receipt with PD, send an email to h1b7yr@dal.dflc.us / h1b7yr@phi.dflc.us to obtain the evidence of the pending backlog case by sending your previous employer details, where it was filed etc., You will get the case details back ( screenshot ) and you can send that as a proof for your further extensions.

My Current H-1B is With Company X which is valid upto Nov 2006,
6 year Limit of my current H-1B Expires in Nov 2006.
Company X is not willing to sponsor my Labor certification.

Another Company Y has filed for my Labor Certification in April 2004 which is pending for more than 365 Days.

If my labor is not approved before my current H-1 Expires,
Can I get my Current H-1B Extened for 7th Year or untill my Labor is Approved

Can You Tell Which Employer has to file for Extension. (Current X or Future Y)

Can I work for Company for Company X after 6-Year H-1B Limit..??

Is it Possible that they can File for 3-year Extension. or only 1-year ..??
