H1b 7th year Extension and I94 date

Hi,

I entered US in July 98 on H1 and I am maxing out in July 2004. I had a H1 transfer in Nov 2002 and the transfered I-797 had an I-94 expiry date of march 2005 (strange and I am not sure why it was extended till march 2005 when I will be maxing out on July 2004).

I applied for labour on June 2003 and I will fulfil the one year requirement for 7th year extension in june 2004.

The issue is that my company says that i need not file the 7th year extension because I have I-94 valid till march 2005. Is this ok? or should I still go ahead and file the 7th year extension?

It's a BCIS mistake. I would not want to have my future depend on that mistake. You should have it corrected and apply for the 7th year H1.
