H1B 7th year/converting to Premium/Out of status?

My current H1B ( 6 years ) expired on Oct 21, 2004. My 7th year extension was filed already on Aug 1, 2004 and it is still pending with NSC.

If I want to convert my regular H1B processing to premium processing, what should be done? My employer says, we cannot do premium because we have to apply fresh now and that would make me out of status as my last H1B expired on Oct 21, 2004. Is it true?

Cannot we convert the already filed H1B extension by paying $1000 using the same receipt number?

Please help.

You can convert from regular to premium processing, any immigration attorney knows how to do it. Look like your employer doesn't know what he is talking.

I also found out that we have to just file FORM I-907 to convert to premium processing. No need to apply fresh.

Wondering why, my employer said it has to be filed fresh again?!!
