H1B 6 Years Calculation

Hi,

Does anybody knows who does 6 year calculations for H1B?. Is it INS or US Consulate/Department of State?.

As far as I know both agencies can count to six.

INS wll deny an extension of status if they determine that the 6 year limit has been reached.

DOL will refuse to issue or revalidate a visa if they determine that the 6 year limit has been reached (this is much more likely at a consulate than in a revalidation scenario)
