Dear Friends:
Please help in my situation here,
I have been in the US since October 1998 and I filed for labor and was approved April 2007 but could not use it for certain reasons and it got invalidated of the new rule I-140 has to be filed in 3 months after labor approval.
My employer is now willing to file through PERM by June 2008, but my H1B visa is expiring by August 2008. At this point will I be able to obtain my H1B extension for another year or do I have to go back to India for a year?
