Graduated with MS in Aug 2007; Worked for a company for 22 days in March 08 through which i filed my H1 which got Approved; OPT expires: 10/09/08; Received I-20 for PhD w/ scholarship for Fall 2008. H1 starts on Oct 01 but i need to join school in Aug. How do i cancel/withdraw my H1 to be in fulltime F1 status for PhD. I understand that only Employer can withdraw the petition. But in my case i did all the paperwork through an attorney as my company is small and i was the first person to be on H1. Please do let me know what FORM does the Employer needs to fill out and mail as i can coordinate that? Secondly, can i join school for PhD as i am still on OPT (F1)???
