H1 visa stamping in India with I797

Hi,

I will soon have an I797 (to go from F1 to H1) and plan to get the visa stamped in India. The attorney for the employer, who is processing the paperwork, advises against travel to India for the next few months because he fears that the consulate will deny the visa.

Does anyone have any statistics on what % of H1 stamp requests are being approved/denied, say at Chennai?

Should not be a problem

As long as you had your legal status all the time in USA. You should not have any problem.

What is the logical reason that your attorney gives you? I would like to know since i am in a similar situation. My attorney never advised me against that, so I am curious.

I agree ...

I just got my H1 Visa revalidated from New Delhi, and know a few others who got their 1st time H1 Visas stamped from there. I don\'t know about the %age of cases which get the visas or get rejected, but your chances should be about the same, whether you apply in India, or in Canada/Mexico.
