H1 visa off still want to get married

Problem : My fiancee has a F1 visa and is finishing up her OPT in January. She was getting a H1 visa but that fell thru with her imployer. We would like to go ahead and get married and do all the nessary paperwork.

Question :

1.) Will she have to leave in January when her F1 visa runs out?

2.) If she can stay, what makes it legal for her to stay here?

Very confused about all this... please help. Thanks soo much in advance.....
 
Once you file the paperwork (I-130 and I485) she becomes legal to stay here (as an adjustee) until CIS decides on the petition.
