H1 Visa Appointment - New Delhi Consulate

Hi,

I have an H1 Visa Appointment at the New Delhi Consulate in August. I am concerned about what documents should be carried by me for the appointment and what sort of complications could arise. My company's lawyers haven't told me much about what I need to do.

Just a brief history about myself -
Graduated with Bachelors from a US university. Worked with a company (that has over 3000 employees) in US on OPT. Was unable to make it to the H1 quota last year. Made it to the quota this year with visa validity starting Oct 1st, 2006. Had to transfer to the India office of my company as OPT expired in May 2006. Will be transferring back to the US office upon successful visa stamp and reentry to US in October.

I had lost my passport and I94 card in 2003 while I was a student. I had filed a police report for missing passport then. I have a new passport now that does not have any visa stamped in it (didn't leave US after 2003).

At the moment I have the following documents -
University diploma and Transcript
H1 application packet from lawyers that includes LCA and approval, copies of I-20, I-94, etc.
Original job offer letter with the company in US (dated April 2005)
Job offer letter from India branch (dated May 2006)
Transcripts from high school
Pay stubs for last 3-4 pay periods in US
SSN Card
EAD Card
Copy of old passport
Copy of police report

Please tell me if anyone believes I would be needing any more documentation. I still have around a month and a half to arrange for documents to be sent to me from US.

Appreciate any help.

Thanks,
Sudhir

Dear Sudhir,

Get a letter from your company in US that you are continuing to work for them and your present status with them is valid based on your I-797.

Carry your DS-156 and 157 forms, a photograph as per their specifications, a DD for Rs. 2300/- as visa issuance fees

If you work for a client, a letter from the client stating all your details

Hope this helps, if not drop a line in the forum thread. Good luck

Subramanya,

Thanks for your response. Really appreciate it. I think I'll ask my company to provide me a letter about continuing work. I work in an R&D facility so I won't need to worry about the client letters. Please do post if you feel any other documents would be required.

Now a question about the photograph, the forms say it should be 50mm x 50mm. How strict are these dimensions? The photographs that the local photographer gave me are 50mm x 49mm. Do you think that would be acceptable?

Thanks once again,
Sudhir

Hi Sudhir,

Adhere to norms and rules. Do not cut corners even by a mm. It may not matter since they are truly not going to measure in front of you and say that your photograph is a mm short thus you have to resubmit your photos, your visa will be kept on hold and due to this we need additional processing etc.

As I write in the forum do not invite questions for not doing something. Do everything right as far as possible, mistakes do take place, be ready to sort them out.

Good luck

Subramanya
