H1 v/s EAD

Filed for I-140/485 concurrently in 10/10/2003 in VSC

Got my EAD card on 11/15/03
H1 is expiring in 7/1/2004 (so about 8 months left)
Company is not doing good and can lay off people now.


Given all the above facts

- Is it better to be on H1 or use EAD card ?

- What happens to your "STATUS" if you are laid off when you are on a EAD card and your I140/485 is still pending ?

2 Scenarios possible.
[1] If your 140 is approved by the time you are laid off, find a job in the same field as previous. After 6 months of 485 apply for AC21.
Renew your EAD as and when required.

[2] If I140 is not approved by that time, go beg your employer and ask them to reply to any RFE if they are generated.
